Unfair dismissal claims can be expensive and time consuming; the best way to protect against these claims is through effective performance management.


This incisive and practical training course provides participants with the essential skills and knowledge to manage staff in order to minimise the risk of lengthy and expensive litigation claims.


Participants will be guided through relevant legislation that forms the framework for the performance management process. We will also address concepts such as procedural fairness and burden of proof.


The course covers both informal and formal procedures that should be undertaken when counselling employees. Participants will learn when each procedure is appropriate, how to arrange the discussion and how to outline the problem. The session identifies potential outcomes of a counselling interview and how to conduct a dismissal discussion. We also highlight the unfair dismissal application and resolution process.


As part of our Toolbox Series, participants will receive template letters covering:

  • Dismissal during minimum employment period;
  • Record of discussion and warning;
  • Termination of employment (with notice and summary dismissal).
