The Hon. Graeme Watson

Vice President Fair Work Commission

Presentation Topic: Fair Work Insights - an insider's insight into the Fair Work Commission and Penalty Rates

Graeme Watson was recently described as one of the most brilliant industrial lawyers of his time.

Until very recently he was Vice President of the Fair Work Commission having been appointed by the Howard Government in 2006. On the Commission for over 10 years, he was panel head for a variety of industries including Airlines, Ports, Maritime, Oil and Gas, Restaurants, Hospitality and Retail.

He was a member of the award modernisation Full Bench that consolidated approximately 1700 awards to 122 modern awards in an 18 month period in 2008-9. He subsequently varied the retail award to reduce the minimum engagement period for school children after work and his decision was upheld by a Full Bench and the Federal Court. He was involved in many important Full Bench cases and is widely regarded as having a major impact on decisions of the Commission over the period of his tenure.

Prior to his appointment he was a partner of Freehills where he advised many large corporates including Rio Tinto, Shell, BHP, Commonwealth Bank and McDonalds.

When he resigned from his position in January this year he advised the Minister for Employment Michaelia Cash that, in his view, the operation of the workplace relations system is undermining the Fair Work Act objectives of promoting national economic prosperity and social inclusion.

Graeme will speak candidly on his insights into the Fair Work Commission, how the recent penalty rates decision affects retailers, and issues with the current system with a particular focus on the retail industry, at all four of the State of the Retail Nation forums.

This will be one of his first speaking engagements since departing the Fair Work Commission at the end of February.
